I recently asked fender for a malmsteen signature strat neck. The reply I got stated that they no longer sold parts separately. I came across this neck made by allparts;- www.allparts.uk.com/catalogue/product_info.php?cPath=91009_91085&products_id=12032Does anyone have experience of allparts necks versus Fender? Its quite expensive so would like a few peoples opinions before I buy. As an aside, What is the copyright situation on licensed parts. Would I be within my rights to apply a fender decal on a licensed part? The rest of the strat is fender spec or higher. I have always wondered about this. Bobble

Someone must have an opinion I dont want anyone to slate one or the other,obviously they are both reasonably good necks, just a guide as to which is better, the allparts or keep a lookout for a fender on ebay? Bob

The designs (NOT including the decals) are copyrighted and then Licensed to Licensees (words capitalized since they are both legal definitions).
NO!
If you sold it, used it in a band where you were paid for your work, or even traded it for something else, you would be legally liable for copyright infringement. In essence, you are making a fraudulent representation. If a legal judgment was rendered against you, the typical penalty for copyright infringement is $10,000 per instance.
It doesn't matter since the part wasn't Fender produced, but appears to be a Fender product (why the decals are controlled).
It's a business, they take it most seriously since there's money involved!
I could be wrong, but a competitor directly copied a printed circuit board that I'd designed back in the '90s (AND HAD PUT A "COPYRIGHT" NOTICE ON) verbatim. He'd shipped 200 of them. We went after him and he didn't have the $2 million, so he then didn't have a business. Corporate shields don't help in cases of PTO fraud.
You CAN get a REPLACEMENT Fender Malmsteen signature Strat neck IF you OWN said guitar model, and SEND the original neck back to Fender FIRST (IMHO).

btw david gilmour used charvel neck with a fender decal on his black strat back in the eighties. anyway ianal but i don't think he would be sued if he does it for himself or even if he sells the neck afterwards clearly stating that it is not a fender neck.

So the term Licenced by Fender is worthless? Surely if a licence is granted then the quality should be identical to a Fender made part thus qualifying it as a Fender. You have given me something else to look out for when Im buying parts. I guess Ill buy a cheap american standard strat and just heavily mod it. Then the decals will be legal? wont they?

And without wishing to fall out with anyone, why would fender try to prove that a guitar of equal or better quality wasn't theirs. Wouldnt they be shooting themselves in the foot?

REALLY? ?? Thats appalling. I thouight licenced by fender meant you were getting as good to the original as you could get!!! What is a good make of neck then? How were the warmoths that you got? I assume that retail price is no guide either? Would warmoth be able to scallop a neck for me? Thanks dunkelfalke Bob

yep, warmoth does scalloping to quote themselves:
Half Scallop from the 12th through 22nd fret: $90.00
Full Scallop: $110.00
never used warmoth myself because of the crazy shipping cost to germany but i have heard that they make much better necks than fender. also they have lot of more options like compound radius, stainless steel frets, angled headstock (very important imho) and better wood.

dunkelfalke... One thing I noticed about the scalloped Allparts neck. The radius was 7.25. Malmsteens were 9.25. I dont know if that matters to you.

A License entails the Licensee to make a unit that looks like the item design that was Licensed. There may or may not be a quality audit involved.
The headstock shape is a trademark of FMIC. It is Licensed to others for fees.
The name "Fender" is a Registered Trademark of FMIC. Its use denotes brand identity. Aside from the neck mounting plate which may infer brand, it IS the Fender brand identification mark.

Ive ordered one, so Im just waiting to hear how long ir will take to make. Im going with the nine and a quarter radius. Thanks for all the help. Ill post a pic when it arrives, oh and I'm having a WARMOTH decal fitted.
