I'm not so sure about that. I know at least two luthiers who started way back when, and they both built at least one of these. In fact, an early to mid 70's model is hanging over the front door of the store where I (supposedly) work. If someone notices it on the way out, the owner is wont to say "see, we could sell you crap like that, but I think you'll be happier with that guitar you picked out, it's much nicer."
As it turns out, the store's current guitar repairman was an apprentice to that particular luthier, many years ago. He didn't have anything to do with building that one, though.
I think it's more akin to the famed 'cigar box' guitars........ no one can patent that design because it's effectively in the public domain. If Deal did get a patent, then it's ripe for being overturned, due to prior art.

Not only prior art, but it isn't really innovative or non-obvious in any way. But then again, there are all kinds of useless things that have been patented, so it's not a huge surprise.
